Negotiating Time Off for the Birth of Your New Child

Most people assume that they are entitled to a maternity leave after giving birth to a new child. That is not necessarily true. FMLA only applied in certain situations and at organizations that meet certain requirements.

If you find that FMLA does not apply to your organization, talk to your HR or other manager to find out if there are any policies regarding time off for child birth. Even if they don’t fall under the FMLA guidelines, some organizations will still provide something.

In some cases, you may be expected to take unpaid time off or use it any paid time off options you have available to you. Short-term disability may also be provided for these circumstances. It may provide less than 100% of your earnings, but it’s better than nothing.


The amount of time off you need after giving birth is something that you and your doctor will work out. You’re going to need some time to recover and you will want to enjoy those precious moments with your new baby. In addition, most day care providers won’t take a baby until it is at least six weeks old so unless you have family to care for the child, this needs to be a factor in when you return to work as well.

Remember that once you have that baby, you need to make sure your insurance carrier is notified to add the baby to your policy. If you forget to do this, you may end up with more out of pocket expenses than you had anticipated.

Having a baby is a wonderful time. Make sure you work out all of the necessary details in advance so you can enjoy that time with your newborn as much as possible.
